Bob Stupar concentrates his practice on lending and servicing of commercial real estate conduit and balance-sheet loans secured by apartment buildings, shopping centers, strip malls, hotels, warehouses, residential developments, office buildings, and other types of commercial real estate. He regularly represents banks, loan servicers, insurance companies and other lenders with respect to commercial real estate loan originations, post-origination loan restructuring/modifications/assumptions, and workouts of non-performing commercial real estate loans (forbearances, discounted payoffs, deeds-in-lieu, note sales, receiverships, foreclosures, and the exercise of other secured creditor remedies).
Mr. Stupar also regularly counsels clients with respect to leasing, management, zoning, and other aspects of ownership and management of commercial real estate.
Mr. Stupar is a frequent speaker at local and national legal and finance industry events in connection with this practice. He speaks French, Bosnian/Serbian/Croatian, and also has basic knowledge of Japanese language.
Assisted one of the largest bank holding companies located in Georgia as the secured party lender in recovery of multiple properties that served as security for residential acquisition and construction loans.
Represented one of the largest worldwide leaders in financial services in loan origination secured by real estate and all related activities related to real estate lending such as title and survey review and negotiation, corporate formation, zoning and insurance report review.
Represented leading financial institutions, as lenders and servicers, in loan workouts involving evaluating viability of loan modification, deed-in-lieu, short sales, receiver appointment, judicial and non-judicial foreclosures, confirmation hearings for preservation of right to seek deficiency judgments, various aspects of negotiation with the property management companies, negotiation of foreclosure insurance policies, and recourse carve-out application.
Represents servicers and lenders in post-origination loan modifications, loan assumptions, and loan defeasances.
Represent lender in several disputes concerning a $70 million loan. Prevailed in bench trial on lender’s ability to pursue borrower and guarantor for $53 million deficiency. Presently representing the lender in federal lawsuit against borrower, guarantor, and alleged alter egos of the guarantor.
Represented large insurance company in a multimillion dollar interim and permanent loan secured by a portfolio of self-storage facilities.
