U.S. Customs has the power to seize and detain imported goods for violating trademark or copyright, but not patents. The Counterfeit Goods Seizure Act of 2019, introduced in December 2019, would add U.S. design patents to the types of intellectual property that Customs can enforce. This webinar will briefly discuss the enforcement mechanisms already available for U.S. design patents, how enforcement may work with U.S. Customs if the Act becomes law, and the pros and cons to these different enforcement mechanisms.
