The value of intangible assets, and especially trade secrets, has risen substantially in the digital era and, at the same time, the theft of trade secrets (and the risk of theft) by company insiders and rogue employees has increased dramatically. This presentation will address these recent trends, including statistics and examples, with observations about potential reasons for the increase in trade secret litigation in recent years. The program will uncover best practices under current law for guarding against “outbound” theft by departing employees and best practices for limiting the risk of “inbound” misappropriation when a company recruits new employees from a competitor. The presentation will also cover specific developments and current U.S. case law under the four-year-old federal statute, the Defend Trade Secrets Act, and differences between the federal statute and the Uniform Trade Secret Act adopted by most states.
