Insights: Events Disputes Arising from Artificial Intelligence

IBA Annual Litigation Forum

Technology raises many issues when it comes to control, responsibility, transparency and liability. There is an increasing amount of case law on the underlying legal issues. The panel will focus on the key challenges we are facing as machines become increasingly intelligent. Adequate distribution of responsibility is a particular concern. In a chain of computer instructions when the computer also instructs itself, can a human being still be identified as liable or is it the machine, and possibly its owner, which has to shoulder liability? Additionally, artificial intelligence is progressively becoming an issue when it comes to evidence before a court of law. How can you prove that algorithms work flawlessly on a nondiscriminatory basis?  What is the right standard of evidence when there is a dispute about possible ‘mistakes’ that a machine and intricate technology have made?
