This panel will discuss three cases currently pending before the U.S. Supreme Court: Herrera v. Wyoming, Carpenter v. Murphy, and Washington State Dep’t of Licensing v. Cougar Den Inc. These cases involve treaty hunting rights (Herrera), a criminal case raising the question whether the historic reservation of the Muscogee (Creek) Nation was disestablished (Murphy), and whether the imposition of a state fuel tax upon a member of the Yakama Nation is preempted by treaty (Cougar Den). Tribal advocates in these cases will discuss their experiences at the Supreme Court and the implications of these cases for all tribes nationwide.
