At its core, the practice of law is an exercise in problem solving. Sometimes the problems involve difficult personalities, strong emotions, or unreasonable demands. When Joe Dowdy was tasked with resolving problem consumer cases at the height of the financial services crisis, he studied social and behavior science literature for insights on how to address significant demands fro upset customers with lawsuits pending in difficult jurisdictions. This CLE will share those insights and Joe's experiences regarding effective techniques. This CLE will also provide a refresher of the ethical obligations involved in negotiating with opposing counsel and an update on procedures involved in settling litigation through mediation or otherwise.
