Overview

Harris Henderson focuses his practice on intellectual property litigation in both copyright and trademark law.

While in law school, Mr. Henderson received the American Bar Association & Bureau of National Affairs Award for Excellence in the Study of Intellectual Property. Prior to law school, Mr. Henderson spent two years working in the film industry culminating with two of the films he was involved with premiering at the Sundance Film Festival in 2007.

Mr. Henderson was recognized as a 2017 and 2018 North Carolina "Rising Star" for Intellectual Property by Super Lawyers magazine.

Experience

Successfully defended Virginia Polytechnic Institute and State University (Virginia Tech) in trademark infringement litigation against Hokie Real Estate, a real estate agency that adopted a maroon and orange color scheme in their advertising and business cards. The defendant filed a number of counterclaims alleging fraud on the trademark office and trademark misuse. The court granted Virginia Tech's motion to dismiss the counterclaims on sovereign immunity grounds. Case subsequently settled on favorable terms. Virginia Polytechnic Institute and State University v. Hokie Real Estate, Inc., No. 7:10-cv-00466 (W.D. Va. filed Oct. 18, 2010).

Represented fourteen universities in trademark counterfeiting and infringement litigation against a company that sold counterfeit cheerleading uniforms and other unlicensed items bearing university trademarks. The court granted a temporary restraining order and authorized immediate seizure of the counterfeit merchandise, manufacturing supplies, financial records, and computer hardware from the defendants. The case subsequently settled on favorable terms, including entry of a permanent injunction and final judgment in favor of the universities. The University of Georgia Athletic Association, Inc. et al. v. Signature Diversified, Inc. et al., No. 4:12-CV-107 (N.D. Ga. filed May 8, 2012).

Represents a leading footwear and apparel manufacturer in trademark litigation and enforcement work.
