"Better to Give Than to Receive: Prosecuting and Defending Bribery and Corruption Cases Post-McConnell," Panelist, American Bar Association Criminal Justice Section Southeastern White Collar Crime Institute, September 2017.

Following the 2016 vacated conviction of former Virginia Governor Robert McDonnell by the United States Supreme Court, the bar has been raised in proving federal criminal public corruption cases. This panel will discuss and examine the investigation and prosecution of public officials and the evolving theories that the Government has used to charge these individuals. As noted in the McDonnell case, an official act “must involve a formal exercise of governmental power, and must also be something specific” - a holding which raises the bar on what constitutes corruption within the meaning of the relevant criminal statutes. Finally, the panel will discuss effective defense tactics in defending public officials in federal criminal cases.
