Manufacturers recognize that the ever increasing volume in tort litigation adversely affects reputation, profitability, innovation and jobs. They must invest resources defending their organizations against such claims. We are renowned for product liability and toxic tort work, having been recognized as one of the country’s top practices in this area. Our attorneys defend manufacturers in all types of product liability and toxic tort cases in state and federal courts across the U.S. and before state and federal administrative agencies, involving claims for property damage, personal injury and wrongful death, as well as cases involving allegations of consumer fraud and related commercial claims.
We have a wealth of experience managing complex litigation, including class action, mass tort litigation, MDL and other coordinated proceedings. We also serve extensively as national coordinating counsel to manufacturers in toxic exposure claims and develop internal risk management programs for those clients.
The types of toxic tort cases we handle include claims involving PCBs, DDT, dioxin, warfarin, formaldehyde, phenol, benzene, MTBE, mercury, perchloroethylene, vinyl chloride, chlorine, lead, asbestos, silica, manganese, and various other chemicals, pesticides, fungicides and herbicides. Our class action and mass tort experience includes personal injury claims related to birth defects, cancer, and other diseases and property damage claims related to contamination of air, water, and soil. We also defend a wide variety of product liability lawsuits involving products manufactured by companies in the pharmaceutical and medical device, automotive, consumer product, carpet, chemical, paper, plastics, protective fabrics and telecommunications industries.
We recognize that a product liability practice involves not only defending manufacturers, but assisting clients in developing a consistent, cost-effective approach to risk management and litigation. We leverage our success in court to help manufacturers minimize and avoid liability upfront. Our lawyers have considerable experience advising clients on preventive measures that reduce the risk of liability without compromising strategic business objectives. In this role, we regularly provide counsel concerning regulatory compliance issues and interface with government agencies.
Our Product Liability team combines extensive litigation experience with technical knowledge of lawyers who have backgrounds in engineering, biological sciences, chemistry and medicine. The varied subject matter of our work often lends itself to cross-department collaboration with lawyers and scientists in our environmental, patent and life science litigation groups.
