WASHINGTON, D.C. (February 23) – Kilpatrick Townsend & Stockton announced today that attorneys Michael Mancusi and David Cox served as featured panelists on a D.C. Bar Panel. The program, “ The Bank Has Failed: Now What?,” was held on February 23 at the D.C. Bar Conference Center.
Mr. Mancusi and Mr. Cox participated on a panel that discussed what a depositor can expect upon learning that the depositor's bank has failed and what a creditor of the bank, holding company, or other investor in the bank can expect when it learns that the FDIC has been appointed receiver for the bank. The panel discussions also covered the need for independent representation of officers and directors; D&O insurance coverage issues; areas of potential fraud, including secondary fraud and fraud perpetrated by the desperate banker; and legal issues raised by the bankruptcy of the holding company.
Mr. Mancusi represents foreign and domestic banking organizations in regulatory, compliance and enforcement matters and has substantial experience representing clients in government and corporate internal investigations. Mr. Mancusi counsels clients on corporate governance issues and banking organization and structure issues, including the use of bank charters, operating subsidiaries and bank holding companies under the National Bank Act, the Federal Reserve Act, the Bank Holding Company Act, the Federal Deposit Insurance Act, the Bank Merger Act and state banking laws.
Mr. Cox focuses his practice on insurance coverage and complex commercial litigation issues. He has experience representing corporate policyholders in connection with civil actions, arbitrations, mediations, and negotiations involving a wide range of commercial insurance and reinsurance issues including insurance company bad faith and coverage for asbestos bodily injury disputes, environmental liabilities, catastrophic property losses, copyright infringement, construction defects, theft, directors’ and officers’ liability, professional malpractice, property damage and business interruption.
