This presentation will address recent case law relating to disputes between the FDIC and bank holding companies, or their bankruptcy estates, regarding which entity is entitled to tax refunds generated by the carry-back of net operating losses originated by failed banks that have been placed into FDIC receivership. There are numerous cases throughout the country dealing with this topic and the circuit courts have started to issue decisions that have or will be appealed to the Supreme Court.
