The Romare Bearden Foundation, which preserves and perpetuates the artistic and intellectual legacy of renowned African-American artist Romare Bearden, sought pro bono legal counsel to clarify the Foundation's relationship with Bearden's heirs and draft a contract memorializing their relationship. When we located and reviewed the artist's will and related documents, we concluded that, unbeknownst to the Foundation, there were strong arguments that the Foundation owned many original Bearden artworks and all copyrights he owned at the time of his death. Because the matter raised complex trust and estates, charitable foundation, copyright and corporate issues, Lisa assembled a cross-departmental team, which worked tirelessly over several years to clarify and formalize the relationship between the Foundation and the heirs and to negotiate an amicable resolution of their differences. As a result, the Foundation now owns outright nearly 100 valuable artworks, Bearden's archives, and essentially all of the copyrights owned by both Romare Bearden and his wife at the time of their respective deaths.
