Served as lead litigation counsel for lender and loan servicer in a case involving allegations that the lender lacked a reasonable and good faith belief that borrowers could repay the loan at the time it was consummated, in violation of N.C. Gen.Stat. § 24–1.1F(c). Borrowers sought a declaration of usury, a refund of all interest, adjustment of the interest rate to zero percent, actual damages, statutory treble damages, and attorneys’ fees. Mr. Dowdy successfully removed the case and obtained dismissal of the complaint pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure.
