Represented Alliance of Professionals & Consultants, a major temporary staffing company, in a lawsuit in federal district court in Atlanta against a former employee who downloaded our client’s proprietary pricing software to start a competing enterprise. We filed a complaint against the former employee alleging civil RICO, Computer Fraud and Abuse Act, trade secret misappropriation, and related claims based on allegations of theft of client data. We obtained an emergency ex parte temporary restraining order against the employee that resulted in the confiscation of his computer, and we ultimately obtained a permanent injunction and monetary damages from the employee after a trial before the district court.

Alliance of Prof'ls & Consultants v. Munley, No. 04-3288 (N.D. Ga. filed July 28, 2005).
