Defended Zynga against the plaintiff’s allegation that Zynga’s MAFIA WARS game infringed the plaintiff’s trademark rights in its pre-existing franchise of MAFIA WARS games on mobile devices. The Plaintiff sued in the U.S., Finland, and in Germany. We developed a global defense strategy including acquiring earlier rights to preexisting marks, supervised successful secondary meaning surveys, and balanced attacking the plaintiff’s mark as descriptive with maintaining our ability to assert rights against third parties. We moved for preliminary injunction in Finland to gain leverage, and were able to settle the case on favorable terms following early mediation, allowing Zynga to gain worldwide prior rights to the mark for gaming.
